Lasting Power of Attorney

Lasting Power of Attorney

A Lasting Power of Attorney is a British legal document that allows you to appoint a person or people of your choice to make decisions on your behalf in the future.

The main reason people choose to complete a Lasting Power of Attorney is so that you have nominated a person or people in advance who will be able to make decisions on your behalf when you are unable or incapacitated. This may be permanent or temporary, depending upon your health.

Where you have failed to nominate a person or people for these tasks, purposely, your spouse or partner may not have the legal responsibility to be able to carry out these tasks for you and a government Department will make your decisions for you, connected to your health, welfare, property and financial affairs.

There are two different types of Power of Attorney and you can choose to complete one or both. They are called:-

Health and Welfare – the powers can only be used after you become unable to make your own decisions
• Property and Financial Affairs – the powers can be used at any time

Health and Welfare Lasting Power of Attorney

This document allows you to choose one or more people to make decisions about your medical care, moving into a nursing home care, refusing life-sustaining treatment and how will carry out your daily routines like eating, washing and what you wear.

Property and Financial Affairs Lasting Power of Attorney

This document gives one or more people the permission to handle and make decisions about your money and your property, like collecting benefits, paying your bills or selling your home.

The people who you choose as attorneys for one document can be different from the people you choose for the other. You may consider this is correct, or you might believe it is extremely congregated for the people to carry out the tasks for you. This is why it is important to choose the right people for the right task.
